I think with enough discussions with Handspring, they would replace your Edge for free. You had it in THEIR case, which THEY manufacture to protect your Edge, and it did NOTHING. So technically, their case was falsely advertised as being a PROTECTIVE case rather than simply a decorative one. Well, it's too late for that. I had already called them and requested a repair, so my new Edge is on the way... for $89.25. So that's settled, I'm not arguing with them, the end.
Now to address your point. I really don't see how I COULD win such a case (a case case... ha ha...), frankly. Handspring does not guarantee their cases for any particular level of protection. I think the general idea is that the protective case is suppose to protect it from the typical bumps and bruises of everyday life - being bumped around inside a briefcase or bookbag, dropped a foot or so onto the counter, etc. I, on the other hand, practically *threw* the Visor at the floor from a height of four feet. I don't think the case really has enough protection for that sort of thing. Looking at the case right now (I have it open next to me), it is really nothing more than a few thin pieces of metal-coated plastic. There is no shock-absorbing material, no foam padding, nothing along those lines. So my guess it is intended to protect from minor dings and scratches and minor impacts, but not from a high velocity impact...
Companies which intend their products to offer a specific level of protection usually explicitly state so, and offer something to back it up. The Kryptonite "Manhattan" bike lock, for example, comes with a guarantee that it will not be broken, and offers cash up front if that guarantee is ever violated.... Handspring's case, on the other hand, came with absolutely nothing but the box. No warranty, no terms, etc... as is, no guarantees.
